These Terms of Service govern all interactions with Zinal’s Homoeopathy including in-clinic consultations, teleconsultations, website usage, WhatsApp communications, and Instagram engagement. Please read them carefully. By signing the patient registration form, ticking the acknowledgement checkbox on our website, or continuing to use our services, you confirm that you have read and agree to these Terms.

1. About These Terms

These Terms of Service (“Terms”) govern your relationship with Zinal’s Homoeopathy, operated by Dr. Jinalben Chavda, a qualified and registered Homoeopathic practitioner. “Services” includes in-clinic consultations, teleconsultations, WhatsApp communications, the informational website, and the Instagram account maintained by Dr. Jinalben Chavda.

1.1 How You Agree to These Terms

Agreement to these Terms is established through one or more of the following documented mechanisms:

• In-clinic patients: by signing the patient registration and consent form, which includes an express acknowledgement that the patient has read and agrees to these Terms

• Website visitors: by ticking the Terms acknowledgement checkbox on any contact or enquiry form on our website

• Teleconsultation patients: by verbal confirmation at the commencement of the first teleconsultation, which is recorded in the patient’s case file

• Instagram followers: by engaging with our account after the Terms are displayed in the account bio and pinned post

If you do not agree to these Terms, you must not use our services. Continued use of our services constitutes ongoing acceptance of the current version of these Terms.

1.2 Relationship with Privacy Policy These Terms must be read together with our Privacy Policy, which governs how your personal and health data is collected, used, and protected. In the event of any conflict between these Terms and the Privacy Policy on matters of data protection, the Privacy Policy shall prevail.

2. Nature of Homoeopathic Practice

2.1 Recognised System of Medicine

Zinal’s Homoeopathy provides homoeopathic medical care as a standalone or complementary health service. Homoeopathy is a recognised system of medicine under the Homoeopathy Central Council Act, 1973 and is regulated by the Central Council of Homoeopathy and the applicable State Homoeopathic Medical Council of Gujarat.

2.2 Medical Emergency — Critical Notice

Homoeopathic treatment is NOT a substitute for emergency medical care. If you are experiencing a medical emergency — including chest pain, stroke symptoms, severe allergic reactions, breathing difficulty, high fever with altered consciousness, or any life-threatening condition — call emergency services immediately on 112 or go to the nearest hospital. Do NOT contact Dr. Jinalben Chavda via WhatsApp, Instagram, or phone as a substitute for emergency care. The practice accepts no liability for harm arising from a patient’s failure to seek emergency medical care.

2.3 No Guarantee of Outcomes

Treatment outcomes vary from patient to patient. No guarantee of cure, specific recovery timeline, or particular result is made or implied by any content on our website, Instagram account, or in any verbal or written communication. Testimonials reflect individual experiences and do not constitute a promise of similar outcomes for other patients.

2.4 Complementary Care Disclaimer Homoeopathic treatment may be used alongside conventional medical treatment. Patients are strongly advised to inform all their treating doctors — both homoeopathic and allopathic — of all treatments and medications they are receiving. Zinal’s Homoeopathy does not advise patients to discontinue any ongoing allopathic treatment without appropriate medical supervision.

3. Consultations

3.1 In-Clinic Consultations

Consultations are by appointment only. A consultation commences only after the patient has completed the signed registration form and provided informed consent. Late arrivals may result in a shortened consultation or rescheduling at the practitioner’s discretion.

3.2 Teleconsultations

Teleconsultations are conducted via video call or phone in compliance with the Telemedicine Practice Guidelines, 2020. Every teleconsultation is formally documented in the patient’s case record. The following conditions apply:

• Patients must provide accurate identity information and confirm their location before a teleconsultation begins

• Teleconsultations will not be conducted for first-time patients presenting with acute, complex, or potentially serious conditions — an in-person visit will be required in such cases

• Dr. Jinalben Chavda reserves the right to decline a teleconsultation and require an in-clinic visit where physical examination is necessary for safe clinical assessment

• A teleconsultation is a formal medical interaction and the same professional standards apply as for in-clinic consultations

3.3 WhatsApp Communications

WhatsApp is used strictly for appointment scheduling, follow-up reminders, and general administrative correspondence. The following must be clearly understood:

• A WhatsApp message, voice note, or informal chat exchange does not constitute a formal medical consultation under any circumstances

• Clinical advice, prescriptions, or diagnosis will not be provided through WhatsApp outside of a formally documented consultation

• Response times on WhatsApp are not guaranteed and must not be relied upon for time-sensitive health matters

• In the event of any health concern requiring prompt attention, patients must book a formal consultation or contact emergency services as appropriate

3.4 Accuracy of Patient-Provided Information

The quality of diagnosis and treatment is directly dependent on the accuracy and completeness of information provided by the patient. Zinal’s Homoeopathy shall not be liable for any adverse outcome arising from inaccurate, incomplete, or withheld information provided by the patient during or before any consultation.

3.5 Right to Decline or Discontinue Treatment

Dr. Jinalben Chavda reserves the right to decline to accept a new patient or to discontinue treatment of an existing patient. The following notice provisions apply:

• Discontinuation of treatment of an existing patient will be communicated in writing with a minimum of 14 days’ notice, except where immediate discontinuation is necessitated by patient misconduct, abusive behaviour, or a serious safety concern

• In cases of immediate discontinuation due to misconduct or safety, a written explanation will be provided and a referral to another practitioner offered where clinically appropriate

• Discontinuation will not occur in the middle of an acute episode of care without ensuring appropriate handover or referral

4. Appointments & Cancellations

4.1 Booking & Confirmation

Appointments may be booked via phone, WhatsApp, or any booking channel made available by the practice. A booking is confirmed only upon written or verbal acknowledgement from the practice. Unacknowledged booking requests do not constitute a confirmed appointment.

4.2 Cancellation by Patient

Patients are requested to cancel or reschedule appointments at least 3 hours in advance. The following cancellation policy applies:

• Cancellation with 3 or more hours’ notice: No penalty. The slot will be rescheduled or released at no charge.

• Cancellation with less than 3 hours’ notice or no-show without prior notice: A cancellation fee of 25% of the applicable consultation fee will be charged. This fee will be collected at or before the next appointment.

• Repeated late cancellations or no-shows (two or more occasions): The practice reserves the right to require full prepayment of the consultation fee before confirming future appointments, or to decline future bookings at its discretion.

The cancellation fee is disclosed here and on the registration form signed by the patient. By confirming an appointment, the patient acknowledges and accepts this cancellation policy.

4.3 Cancellation by Practice In the event that an appointment needs to be cancelled by the practice, the patient will be notified as soon as reasonably practicable and offered an alternative appointment at no additional charge. No cancellation fee will apply to the patient in such cases.

4.4 Consultation Duration

Booking an appointment does not guarantee a specific consultation duration. Time allocated is at the practitioner’s clinical discretion based on the complexity of the case and the patient’s needs.

5. Fees & Payment

5.1 Consultation Fees

Consultation fees are communicated at the time of booking and displayed at the clinic. Fees are subject to change. Any revision in fees will be communicated in advance and will not apply to already-confirmed appointments.

5.2 Payment

Payment is due at the time of consultation unless otherwise agreed in writing. Accepted methods include cash, UPI, and other methods displayed at the clinic. The practice does not store payment card details — all digital payments are processed through third-party payment systems.

5.3 Refund Policy

Consultation fees are non-refundable once a consultation has been conducted, as professional time and expertise have been rendered. The following exceptions apply:

• Cancellation by the practice: full refund or rescheduling offered at the patient’s choice

• Patient cancellation with at least 3 hours’ notice where prepayment was made: amount credited toward a future appointment

• Patient cancellation with less than 3 hours’ notice where prepayment was made: 25% cancellation fee deducted and balance credited toward a future appointment

5.4 Fee Disputes

Disputes regarding consultation fees should be raised with the practice at zinalshomoeopathy@gmail.com as soon as possible and ideally within 7 days of the consultation to allow timely resolution. This internal preference does not limit any rights available to you under the Consumer Protection Act, 2019 or any other applicable law, under which statutory timelines apply independently.

6. Medicines & Remedies

6.1 Source & Quality All homoeopathic medicines dispensed by Zinal’s Homoeopathy are sourced from licensed homoeopathic pharmacies and are of pharmacopoeial standard in compliance with the Homoeopathic Pharmacopoeia of India and the Drugs and Cosmetics Act, 1940. Medicines are dispensed only as part of a formal consultation.

6.2 Patient Obligations Regarding Medicines

• Medicines are prescribed specifically for the individual patient and must not be shared with or administered to any other person

• Patients must store medicines as instructed and away from strong odours, direct sunlight, and heat

• Patients must inform Dr. Jinalben Chavda immediately of any unexpected reaction, worsening of symptoms, or concern regarding a prescribed remedy

6.3 Adverse Reactions In homoeopathy, a temporary initial aggravation of symptoms is recognised as a possible response to treatment and does not necessarily indicate harm. However, patients must contact the practice if symptoms worsen significantly, persist beyond the period indicated by the practitioner, or if any new or alarming symptom develops. In the event of a serious adverse reaction, patients must seek emergency medical care immediately and inform the practice as soon as practicable.

6.4 Limitation on Medicine Liability Zinal’s Homoeopathy shall not be liable for adverse outcomes arising from: a patient’s failure to follow the prescribed dosage or storage instructions; self-administration of medicines obtained from sources other than the practice; or the patient sharing medicines with or administering them to another person.

7. Website Terms

7.1 Informational Purpose Only

The content on our website is for general informational purposes only. It does not constitute medical advice, diagnosis, or treatment recommendation. Visitors must not rely on website content as a substitute for a formal professional medical consultation.

7.2 Accuracy of Content

We make reasonable efforts to ensure the accuracy of website content. However, medical knowledge evolves and the website may not always reflect the most current information. We do not warrant that website content is error-free, complete, or current at all times.

7.3 Intellectual Property

All content on the website — including text, graphics, photographs, logos, testimonials, and case studies — is the intellectual property of Zinal’s Homoeopathy unless otherwise stated. You may not reproduce, republish, distribute, or commercially exploit any website content without prior written permission from Dr. Jinalben Chavda.

7.4 No Liability for Website Use

Zinal’s Homoeopathy shall not be liable for any loss or harm arising from a visitor’s reliance on website content without seeking a formal consultation. Website content is provided “as is” and access is at the visitor’s own risk.

7.5 External Links

Our website may link to third-party websites for reference. We are not responsible for the content, accuracy, or privacy practices of any linked third-party website.

8. Instagram & Social Media Terms

8.1 General Awareness Only

Content posted on the Instagram account of Dr. Jinalben Chavda is for general health awareness and homoeopathic education only. It does not constitute medical advice, diagnosis, or treatment recommendation. Followers must not act on any Instagram content without first consulting a qualified medical professional.

8.2 No Doctor-Patient Relationship via Social Media

Following, liking, commenting on, or sending a direct message to our Instagram account does not create a doctor-patient relationship. A doctor-patient relationship is established only through a formal in-clinic or teleconsultation.

8.3 No Individual Medical Advice via Social Media

Dr. Jinalben Chavda will not provide specific medical advice, diagnosis, or prescription recommendations through Instagram comments, direct messages, or any other social media channel. Any such request will be directed to a formal consultation. Any general response to a public query on social media does not constitute clinical advice and must not be relied upon as such.

8.4 Standard Disclaimer

“Content shared on this account is for general health awareness only and does not constitute medical advice. Please consult your doctor before making any health decisions. Engaging with this account does not establish a doctor-patient relationship. Individual results may vary.”

8.5 Intellectual Property on Social Media

All content posted on our Instagram account is the intellectual property of Zinal’s Homoeopathy. You may share posts for non-commercial, informational purposes with appropriate credit. Reproduction, modification, or commercial use without written permission is prohibited.

8.6 User Conduct & Comment Moderation

You must not post false, defamatory, misleading, or abusive content in connection with our practice on any platform. We reserve the right to remove comments or block users who post such content without prior notice. This moderation right will not be used to suppress genuine patient feedback or complaints. Genuine complaints should be directed to zinalshomoeopathy@gmail.com where they will be addressed under our formal complaints procedure.

9. Patient Responsibilities

By using our services, you agree to:

• Provide accurate, complete, and up-to-date information about your health history, current symptoms, and ongoing treatments including allopathic medications and supplements

• Inform Dr. Jinalben Chavda of any changes in your health condition, medications, or treatments during the course of care

• Follow the treatment plan and prescribed dosage as advised and communicate any concerns, side effects, or lack of improvement promptly

• Not share your prescribed homoeopathic medicines with any other person, as remedies are prescribed specifically for your individual case

• Not self-diagnose or self-prescribe based on information from our website, Instagram account, or any other general source

• Contact emergency services immediately in the event of a medical emergency rather than relying on this practice for urgent care

• Arrive on time for scheduled appointments and provide at least 3 hours’ notice for cancellations

• Treat Dr. Jinalben Chavda and any support staff with courtesy and respect during all interactions

10. Testimonials & Case Studies

Patient testimonials and case studies are published only with the patient’s explicit written consent obtained through a signed consent form. Verbal consent, WhatsApp messages, or social media comments do not constitute valid consent for publication. By signing the testimonial consent form, you confirm that:

• The content reflects your genuine experience and is accurate and not misleading

• You have reviewed and approved the exact content before publication

• You understand the specific platform(s) on which it will appear

• You may withdraw consent and request removal at any time by writing to zinalshomoeopathy@gmail.com, and content will be removed within 7 working days of the request

All testimonials comply with ASCI Guidelines for Healthcare Advertising. No testimonial will make claims of guaranteed cure or outcomes. All published testimonials carry a disclosure that individual results may vary.

11. Limitation of Liability

11.1 Exclusions

To the fullest extent permitted by applicable Indian law, Zinal’s Homoeopathy and Dr. Jinalben Chavda shall not be liable for:

• Any harm arising from a patient or follower acting on general health content published on the website or Instagram without a formal consultation

• Any adverse outcome resulting from incomplete, inaccurate, or withheld information provided by the patient during consultation

• Any disruption to services caused by a Force Majeure Event as defined in Section 11.4 below

• The content, privacy practices, or services of any third-party platforms including Instagram, Google, WhatsApp, or payment processors

• Any harm arising from a patient’s failure to seek emergency medical care and instead relying on this practice for urgent treatment

• Adverse outcomes from medicines obtained outside of this practice or from self-medication based on general content

11.2 Liability Cap

Where liability cannot be excluded under applicable law, and solely in respect of non-negligence claims, our total liability to any patient in connection with any single claim shall not exceed the total consultation fees paid by that patient in the 12 months immediately preceding the claim.

11.3 Clinical Negligence Carve-Out

The liability cap in Section 11.2 does not apply to claims arising from clinical negligence, gross negligence, wilful misconduct, or any claim involving bodily injury or death. In such cases, liability is determined in accordance with applicable Indian law and the cap shall have no effect. Nothing in these Terms attempts to limit liability in a manner that is impermissible under the Consumer Protection Act, 2019 or any other applicable statute.

11.4 Force Majeure

Zinal’s Homoeopathy shall not be liable for any failure or delay in performing its obligations caused by a Force Majeure Event. A “Force Majeure Event” means any event beyond the reasonable control of the practice, including but not limited to:

• Acts of God, natural disasters, floods, earthquakes, or extreme weather events

• Epidemics, pandemics, or public health emergencies declared by a competent government authority

• Government-imposed lockdowns, curfews, or restrictions on movement or business operations

• Civil unrest, riots, war, or acts of terrorism

• Widespread power failures, telecommunications outages, or internet disruptions not caused by the practice

In the event of a Force Majeure Event, the practice will make reasonable efforts to notify affected patients and resume services as soon as practicable.

11.5 Consumer Rights Preserved

Nothing in this Section 11 limits any rights you have under the Consumer Protection Act, 2019, the Indian Medical Council Act, 1956, or any other applicable Indian law that cannot be contractually excluded. Your statutory rights as a patient and consumer remain fully intact and unaffected by these Terms.

12. Confidentiality & Privacy

All personal and health information is handled in strict confidence in accordance with our Privacy Policy. Key commitments include:

• Your health information will never be shared with third parties without your consent except as required by law

• Clinical photographs will only be used for the specific purpose for which signed written consent was obtained

• No patient-identifiable information will be published on any platform without explicit separate written consent

• You may access, correct, or request deletion of your personal data at any time by contacting zinalshomoeopathy@gmail.com

13. Complaints & Dispute Resolution

13.1 Internal Complaints Any complaint regarding our services should be raised with Dr. Jinalben Chavda in the first instance:

13.2 External Escalation

If you are not satisfied with our response, you may escalate to:

• The Gujarat Homoeopathic Medical Council or relevant State Medical Council for professional conduct matters

• The Consumer Disputes Redressal Forum, Ahmedabad, under the Consumer Protection Act, 2019

• The Data Protection Board of India (once constituted under the DPDP Act, 2023) for data-related complaints

• Any other authority of competent jurisdiction under applicable Indian law

13.3 Governing Law & Jurisdiction

These Terms are governed exclusively by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, subject to the patient’s statutory right to approach the Consumer Disputes Redressal Forum in their own district under the Consumer Protection Act, 2019.

14. Changes to These Terms

We reserve the right to update these Terms at any time. The current version will be displayed at the clinic and on our website with the version number and effective date. Continued use of our services after any update constitutes acceptance of the revised Terms. We encourage patients to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force and effect.

16. Entire Agreement

These Terms, together with the Zinal’s Homoeopathy Privacy Policy and any signed patient consent forms, constitute the entire agreement between the patient or visitor and Zinal’s Homoeopathy with respect to the use of our services. They supersede all prior understandings, representations, or agreements, whether oral or written.
